So my upstairs neighbours are at it again. The pending wife of the couple has latched onto a family daycare upstairs and when she latches onto something she's like a 5 year old that stomps her feet until she gets what she wants. My partner and his brother (who is the pending husband of the couple upstairs) has just started a business of their own and it's still in its infancy and their is barely enough money in the house to keep it running. The wife recently went out to get a job to help pay the mortgage but quit after 1 week due to "workplace differences" and now has what seems to me, as get rich quick scheme. If this new daycare business doesn't get at least 2 full time kids attending within a month, we wont have enough money to afford the mortgage. But wait it gets better! She had a home daycare association person out today to inspect the house and all they need is a front fence, so they are going to put up a front fence..they have no money for the mortgage repayments and stopped the other renovations they had going because of money woes and..front fence.
The sad thing is, I did the math. Two full time attending kids (40 hours per week approx) will net them $26,000 a year, an average job doing the same thing in a childcare (which upstairs can get a job in straight away) is $45,000 working the same hours. My partner pointed this out to them and they both want the home daycare option even there is another business trying to operate out of the house.
Unfortunately neither my partner nor I have the money to move out.
I can hear the children screaming already and it terrifies me.

I don't know the full backstory on this, but is there anything in the rental agreement about using the property to run a business out of? Do they need your approval or agreement, since you're the ones who would have to listen to the "pitter patter" of little feet running back and forth during their business hours?
It's one thing to "work from home," but actually running a business out of a place, with clients coming and going, could be a nightmare! Not only that, but would parking for the parents when they drop off and pick up their kids interfere with you or your neighbors?

Jolly Badger is right, but it's not just about the rental agreement. There may be zoning laws about businesses in that area - it may be zoned strictly residential. If so, then they are SOL as far as running any kind of business at that location. Add to it the concerns about parking, etc that Jolly Badger brought up, and you might have a way to keep this from happening. Good luck.

Upstairs owns the house so they can do whatever they want with it unfortunately. Also it will be a drop off daycare so there will be no need for parking.

I'm not sure I understand all this. If they're upstairs, it's a block of some kind right? So is it leasehold or freehold, or do they own the whole block? Even if they own the entire building you live in, there may be a zoning law that no one can run a business from there, regardless of parking etc. It's worth a try to avoid the horror.
if it's a shared freehold, the thing to do is get the other freeholders to object. I'm not saying anything is guaranteed but I would give it a try.
I wish you luck - it sounds scary. Failing all else, put the word about that they are rubbish at looking after kids!!

It's a house, we live downstairs in a renovated garage. The upstairs couple owns the house. We've voiced our objections and the answer was "deal with it". They live by the rule "it's our house, we can do what we want". The home daycare people have come out and assessed the house and found it to be adequate for a home day care, zoning and all.
